State Preemption and Local Rebuilding: A Best-Practices Framework

Responsible and Resilient Planning Network

A forthcoming RRPN framework examining how state land-use preemption interacts with local rebuilding authority after disasters — and what a best-practices balance looks like.

Forthcoming. This publication is in progress.

When disaster-struck communities rebuild, they do so inside a web of state law that was rarely written with recovery in mind. This framework will examine where state preemption of local land-use authority helps rebuilding communities — and where it hurts them — and propose best practices for legislators, local governments, and residents navigating that balance.
